Is it illegal to impersonate a debt collector?

Wednesday, September 29th, 2010
snowrider asked:

I am wondering if it is illegal to impersonate a debt collection company. I have some former roommates that still owe me some money. Can I send them emails asking for rent, pretending to be a debt collector? What if I pretend to be a debt collector from a real company? What if I pretend to be a debt collector from a made up company? What if I also threaten to bring them to court? What if I ask for more than the rent by asking for a “service fee”? Is that extortion or anything?

Thanks!

If I owe a debt can I pay the original institution instead of the debt collector?

Monday, July 5th, 2010
drakolan asked:

I owe a debt from a few years back and am trying to pay it off. However, the original institution has handed it over to a collections agency and they’ve started accumulating interest on it, almost doubling the owed amount. Is it possible to pay off the -original- institution and sidestep the interest?

Jessica asked:

My bf and I just got our new phone number for our home and we’ve had it for 3 days and there have been 5 or 6 calls a day from debt collectors. They ask for the couple that originally had this number. Sometimes it’s an automatic hang up and sometimes it’s a representative asking us if we know them. They tell us they will take us off their list, but then another debt collector calls and another and another.

Can a debt collector collect money for a company that has filed bankruptcy?

Friday, March 5th, 2010
Asile asked:

We receive calls from a debt collection agency attempting to collect money for a company that went out of business and filed bankruptcy a while ago. Is that legal/justifiable?
But if that company filled bankruptcy, doesn’t that mean that they are no longer required to pay back their lenders or any accts payable?;

How is it that they would still be allowed to recoup their losses but not pay their lenders if they’ve declared bankruptcy.

How can I tell if an email from a debt collector is a scam or legitimate?

Monday, November 9th, 2009
desta asked:

It is the only contact I have received from them. My name is not on the email. The web address included to contact them is not accessible to me. When I tried it, the message read that I needed to try a different domain. I know I have no debts owed. I have not received any mail or telephone calls from debt collectors. Does this sound like a hoax, scam or legitimate email?
