Does agreeing to make monthly payments but them not accepting have anything to do with the debt becoming valid again or does the statute of limitations still come into play? It has been almost 5 years and just now contacting me about an old debt in NC. The limitations for NC is 3 years but I told them I could possibly do a very small amount each month and they said it wasnt acceptable. Im dealing with an atty. by the way. What should I do? Can it still go against my credit if the limitations is up?

What will reset the statute of limitations for debt in Colorado?

Can’t seem to find any Colorado laws detailing what would constitute resetting the SOL on debt collections in the state of Colorado? G/F has some items on her credit report showing 4 years old when the Colorado SOL is 3 years. However, she made some payments on the debt within the past year. I’m wondering if Colorado considers making a payment to be resetting the SOL on that debt, or if the original date would be valid for SOL purposes regardless of her making some payments?

Devin asked:

I have just received a collection for $250 from a previous landlord of over 3 years prior. This landlord also kept my entire deposit at the time. According to the Colorado Statute of Limitations, can he come after me for this debt out of the blue 3 years later?

How can I find out what state a Sprint “debt” originated from?

I’ve been dealing with a debt collection agency trying to make me pay for a phone line I never had. I’ve gone through all kinds of calls, and for some reason, Sprint does have my personal info, and says I did create a home phone account. I have never owned a home phone in my life though. I had them send me copies of the bills, and there were never any calls made on this line, etc. But I’m getting away from my original question.

I am trying to find out what state the debt originated in. This is because the statute of limitation on debt determines the validity of the debt. Different states have different SOL’s so I need to find out what state Sprint debts originate in.

I’ve looked all over the internet, but cannot find any answers. HELP!

Thanks all!
I live in Florida, and did at the time the “debt” originated. I believe the creditor can pick whichever state has the longer SOL. Luckily Florida is 4 years, and that passed a few days ago. kansas is only 3 years, so that’d be great.
